United States District Court Judge for the District of New Jersey grants Summary Judgment to the Secuacus Municipal Utilities Authority, represented by David Pfund, Esq., in a suit by a commercial bakery looking to open a new facility in Secaucus. Plaintiff alleged that the SMUA violated plaintiff’s civil rights in delaying its approval of its application. The United States District Court found that the bakery was subject to the same safety and zoning standards as other businesses, that it had been treated identically to other businesses, and that it had not established that its rights to due process and equal protection of law were violated. The lawsuit was dismissed.
Judge Toskos ruled in favor of Franklin Lakes and the Franklin Lakes Zoning Board, represented by Pfund McDonnell, P.C., in a dispute between neighbors. Plaintiff alleged that the Zoning Board wrongfully approved her neighbor’s renovation in violation of her civil rights. All claims against Franklin Lakes and its Zoning Board were dismissed.
